Dissenting Opinion
(by Mr. Currie):
As the Board~s opinion discloses,
the burning site
in this
case is “200 to 1000
feet” from several homes, and the residents
objected to the proposed burning.
The grant of
the variance
under these conditions
(burning to take place
“at least
500 feet
from the nearest residence”)
is squarely contrary
to the Board~s
unanimous opinion,
one week before,
in City of Lincoln v. Envir-
onmental Protection Agency,
#71—56.
In that case we held that
1000 feet from residences was
too close
for comfort and noted
that more remote sites could easily be found.
If one thousand feet was
too close last week,
five hundred
feet is too close
this week.
I think the Board has
an obligation
to be consi~tent.
