ORDER

The

 Board,

 having considered the record in this proceeding hereby

grants the requested variance subject to the following conditions:

 The duration of

 this variance shall be

for

 3 months from

date after which time the City

 shall be subject to all

the

rules and regulations

 then in effect regarding the burning

or other disposal of trees and

 landscape waste.

2.

 Only elm trees from the City of Carthage are included in this

variance grant, both those infected with Dutch Elm disease

and those

 trees not so infected.

3.

 Burning of the trees shall be accomplished between

 the hours

of noon and

 4:00 p~m.only when the wind vector

 is from the

south or east, when the wind velocity is between

 5 and

 20 knots,

and when the sky is not overcast~

4.

 No fuel of lesser quality than number two fuel oil shall be used

to promote combustion.

5.

 All burning shall be done under the full time direct supervision

of a city or landfill facility employee.

6.

 Non-observance of any of the conditions of this variance shall be

 cause

 for revocation of the variance,
