| On February 19, 2002, Horween Leather Company (Horween) filed a proposal for site-specific rulemaking pursuant to 35 Ill. Adm. Code Part 102.Subpart B and Sections 27 and 28 of the Illinois Environmental Protection Act, 415 ILCS 5/27-5/28 (2000). | |
| Horween operates a facility located in the Elston Corridor Planned Manufacturing District No. 2 at 2015 North Elston Avenue, Chicago, Cook County. The facility produces specialty leathers. Horween seeks relief from the Reasonably Available Control Technology (RACT) rules for volatile organic material (VOM) emissions for the specialty leather coating industry. See 35 Ill. Adm. Code 218.926 and 211.6170. Horween asserts this would allow it to begin producing new waterproof products. | |
| Horween proposes a new rule to limit its VOM emissions to 24 lbs. VOM per 1000 square feet for waterproof leather (12 month rolling average) and 14 lbs. for non-waterproof leather. Horween also proposes to cap its total emissions at 20 tones. Horween notes that the United States Environmental Protection Agency (USEPA) has recently approved a similar rule for waterproof leather as RACT as part of the Maine State Implementation Plan. | |
| Horween asks that the Board waive the requirement that a proposal for rulemaking be accompanied by a petition with at least 200 signatures. See 35 Ill. Mm. Code 102.202(f). The motion notes that the proposed rule will not result in any negative environmental impact when compared to historical production of specialty leathers at this facility and the existing emission limitations in the facility’s Title V permit, and that the waiver of this requirement is further warranted based on the recent acceptance by USEPA and Maine of the same RACT rule. The Board hereby grants the motion to waive the signature requirement. | |
| The petition meets the information requirements of 35 Ill. Adm. Code 102.121 and 102.141 and is accepted for hearing. Finally, the parties are directed to use the caption above in future filings in this docket. | |
