    Proposed Rule. Dismissal Order.
     
    ORDER OF THE BOARD (by T.E. Johnson):
     
    Section 22.4(d) of the Environmental Protection Act (Act) (415 ILCS 5/22.4(d) (2000))
    requires the Board to adopt regulations that are “identical in substance,” as defined at Section 7.2
    of the Act (415 ILCS 5/7.2 (2000)), to underground storage tank (UST) regulations promulgated
    by the United States Environmental Protection Agency (USEPA) pursuant to Section 9003 of the
    federal Resource Conservation and Recovery Act of 1976 (RCRA) as amended (42 U.S.C.
    §§ 6993 (1998)) to implement Subtitle I of RCRA (42 U.S.C. §§ 6991
    et seq
    . (1998)) with
    certain limitations. USEPA has codified its UST regulations at 40 C.F.R. 281 through 283. The
    Board reserved this docket for any UST amendments adopted by USEPA between July 1, 2001
    through December 31, 2001.
     
    During that time period, the only USEPA amendments to the federal UST regulations
    was an action on November 30, 2001 (at 66 Fed. Reg. 59713) relating only to the federal
    authorization of the Minnesota program. Therefore, no action is necessary, and the Board
    hereby dismisses this docket.
