ORDER OF THE BOARD:
On January 24,1996, Oscar Mayer Foods CorporationfKraft Foods, Inc. (Oscar Mayer)
filed a petition for review ofan illinois Environmental Protection Agency (Agency) final
determination ofOscar Mayer’s 20-day and 45-day reports.
The Agency disapproved Oscar
Mayer’sreports on December 20,
1995.
The final determination concerns Oscar Mayer’s sites
located at
1241 North Sedgwick Street and 427 West Scott Street, Chicago, Cook County,
Illinois.
Because there are two different sites, two separate petitions are required.
While the
Board accepts the single petition filed for the purposes ofdetermining timeliness oftheappeal for
the purposes ofSection 40 ofthe Environmental Protection Act, we order Oscar Mayer
to file
2
two amended petitions, each of
which
deals only with one site.
Oscar Mayer shall caption the
amended petition for the site at
1241 North Sedgwick, (LUST incident #940514) as
PCB 96-
162, and shall caption the other for the 427 West Scott Street (LUST incident #940516) site
as
PCB 96-166,
a docket number hereby reserved forthis purpose.
If amended petitions curing this deficiency are not filed within 45 days of the date of this
order,
these dockets maybe subject to dismissal.
A
$75.00 filing fee will,
ofcourse, be required
at such time as Oscar Mayer files the amended petition PCB 96-166.
The filing ofthe amended
petitions
will
restart the Board’s decision time clock.
