petition in this matter filed by
Nunda Water Utility Co., Inc.
(Nunda) on December 26,
1995 was deficient.
The Board
noted that if Nunda should wish to pursue this matter it would need to ifie an amended
petition.
The Board gave Nunda 45
days to amend the petition or face dismissal.
The

days has now run and the Board has received no response from Nunda.
This
matter is accordingly hereby dismissed and this docket is closed.
The Board notes that today’s action moots the motion
to dismiss Nunda’s petition filed
by fflinois Environmental Protection Agency (Agency)
on January 11,
1996.
