    1995, the Illinois Environmental Protection Agency (Agency) and
    AT & T Communications, Inc. (AT & T) filed a notice ofextension ofthe 35-day appeal period
    pursuant to Section 40 of theEnvironmental Protection Act (Act), relating to an October 24,
    1995 Agency final reimbursement decision.
    The Agency requested the extension “to January 22,
    1996, or any other date not more than a total of90 days from the date ofthe Agency’s final
    determinaiion.”
    By order of December 7,
    1995, the Board reserved Docket PCB
    96-121 for any petition
    which might be filed by AT & T.
    The order stated,
    “In the eventthat A,
    & T fails to file an
    appeal
    on or before January 22,
    1996 (the 90th day after October 24,
    1995), the Board will
    dismiss the docket as unnecessary.”
    No petition has been filed.
    This matter is dismissed and the docket is closed as unnecessary.
    IT IS SO ORDERED.

    orders within

    days ofthe date of service ofthis order.
