AGENCY’S COMMENTS
The Illinois Environmental Protection Agency (“Agency”) respectfully submits its
public
comments in the above-titled matter to the Illinois Pollution Control Board (“Board”) pursuant to
35 Ill. Adm.
Code
102.108 and at the direction ofthe Hearing Officer.
The revisions suggested in this document came to the Agency’s attention during a
primacy review with U. S. EPA Region 5.
The revisions pertain to changes to previously adopted
regulatory language, and are needed in order for U.
S. EPA to agree that the Illinois regulations are
as stringent as federal regulatory language.
The proposed revisions
are as follows:
1.
Section 611 .742(a)(1 )(A) pertains to the use of data collected under specific provisions of
the Information Collection Rule for use in determining parameters for Total
Trihalomethane
sampling.
The citation given as “Section 611.382”
should be
corrected to 40 CFR 141.142.
The Board did not adopt the Information Collection Rule, so there is no corresponding
state citation.
2.
Section 611 .742(a)(2)(A) pertains to the use ofdata collected under specific provisions of
the Information Collection Rule for use in
determining parameters for Total Trihalomethane
sampling.
The citation given as “Section 611.382”
should be corrected to
40 CFR 141.142.
The Board did not adopt the Information Collection Rule, so there is no corresponding
state citation.
3.
Section
61 1.742(a)(5) has an error in the introductory statement.
The inclusion note should
be changed to “subsections (a)(1)(A) through
(~).
4.
There are two corrections needed in Section 611 .742(a)(5)(A).
The first is a typographical
error, “date” should be
changed to “data”.
Section
