    ORDER OF THE BOARD (by C.A. Manning):
     
    On October 18, 2001, the Board, at the parties’ request, extended until
    January 9, 2002, the time period within which Marcley Oil Company (Marcley) may appeal a
    September 6, 2001 determination of the Illinois Environmental Protection Agency (Agency).
    See
    415 ILCS 5/40 (a)(1) (2000); 35 Ill. Adm. Code 105.406. The Agency denied, in part,
    Marcley’s request for reimbursement of corrective actions costs regarding Marcley’s facility in
    Aurora, Kane County. Because Marcley failed to timely file an appeal, the Board dismisses this
    case and closes the docket.
     
    IT IS SO ORDERED.
