On December 6,
1991, the Board issued its Supplemental Opinion
and Order remanding this matter to the Village
of Romeoville for
a definitive determination as
to criterion
1 of Section 39.2(a).
On January
9,
1992,
the Village of Roineoville filed a copy of its
Resolution no.
801-92, passed on January
8,
1992.
Consistent
with
the
procedure
adopted
in
Clean
Quality
Resources,
Inc.,
PCB
90—216,
April
11,
1991,
this
docket
will
remain closed.
Because there may be
new
issues arising from the
Village’s Resolution,
to preserve its rights Land and Lakes will
need to file a new petition for review with the Board pursuant to
Section 40.1 of the Act and
35
Ill. Adm.
Code 101 within
35 days
of the date of the Village’s resolution.
Because the remand was
not the fault
of Land and Lakes,
the filing fee will be waived.
The new petition should specify which portions of the record
in
this matter should be
incorporated into any new docket,
and the
Board will waive the requirement of
35
Ill.
Adm.
Code 101.106(a)
that four copies of the required material be filed with the Board.
Again, this docket remains closed.
