ORDER OF THE BOARD (by R.C. Flemal):
On December 28, 2001, petitioner filed a petition for variance (petition). Pursuant to 35
Ill. Adm. Cod 104.204, petitioner requests a hearing. The Board accepts the matter for hearing.
The Board directs that this matter proceed to hearing as expeditiously as practicable. The
assigned hearing officer must set the matter for hearing in accordance with the requirements of
the Environmental Protection Act (415 ILCS 5
et seq.
(2000)) and the Board’s procedural rules.
It is the responsibility of the hearing officer to guide the parties toward prompt resolution of this
matter, through whatever status calls and hearing officer orders he determines are necessary and
appropriate. Unless otherwise ordered by the hearing officer, the Illinois Environmental
Protection Agency recommendation must be filed with the Board within 45 days after the filing
of the petition (in this instance, February 11, 2002), or where there has been a hearing scheduled,
at least 30 days before hearing, whichever is earlier.
