    ORDER OF THE BOARD (by C.A. Manning):
     
    On December 6, 2001, the Board, at the parties’ request, extended until March 12, 2002,
    the time period within which Amtrak may appeal a November 7, 2001 determination of the
    Illinois Environmental Protection Agency (Agency).

    415 ILCS 5/40 (a)(1) (2000); 35 Ill.
    Adm. Code 105.406. The Agency rejected Amtrak’s site classification completion report for
    Leaking Underground Storage Tank (LUST) Incidents 980038, 982270, and 912018 in Chicago,
    Cook County.
     
    On January 4, 2002, Amtrak filed notice with the Board that Amtrak is transferring this
    area from the LUST program to the Site Remediation Program. Therefore, Amtrak stated that it
    will not be filing an appeal of the Agency’s decision in this matter. As no appeal will be filed,
    the Board dismisses this case and closes the docket.
