ORDER OF THE BOARD (by C.A. Manning):
On December 6, 2001, the Board, at the parties’ request, extended until February 20,
2002, the time period within which Amtrak may appeal an October 18, 2001 determination of the
Illinois Environmental Protection Agency (Agency).

Adm. Code 105.406. The Agency rejected Amtrak’s high priority corrective action plan for
Leaking Underground Storage Tank (LUST) Incident 980039 in Chicago, Cook County.
On January 4, 2002, Amtrak filed notice with the Board that Amtrak is transferring this
area from the LUST program to the Site Remediation Program. Therefore, Amtrak stated that it
will not be filing an appeal of the Agency’s decision in this matter. As no appeal will be filed,
the Board dismisses this case and closes the docket.
