ORDER OF THE BOARD (by M. McFawn):

This matter is before the Board on a motion to postpone

filing the record as submitted by the Illinois Environmental

Protection Agency (Agency) on November 13, 1995. The decision

deadline in this matter has been waived making the case due at

the Board’s May 16, 1996 Board Meeting. While the parties

negotiate compliance options, the Agency requests an extension of

time in which to file the record. The Agency, without objection

from the petitioner, and barring any future waivers of the

decision deadline, proposes to file the record no later than 60

days prior to the case being due, or by March 25, 1996.

The motion is hereby granted. The record in this case is

now due by March 25, 1996. Any future extensions of the record

filing date are to be directed to the hearing officer.
