ORDER OF THE BOARD
(by (IT. Girard):
Section 9.1(e) ofthe Environmental Protection Act (Act) requires the Board to adopt
regulations which are
“identical in substance” to exemptions from the definition of“volatile
organic material” those compounds that USEPA has found to be exempted from regulation under
state implementation plans for ozone due to negligible photochemical reactivity.
TJSEPA has
codified these exemptions as part ofits definition at 40 CFR 51.100(s).
Accordingly, theBoard
reserved this docket for USEPA amendments during the period from July
1 through December
31,
1995.
However, USEPA did not amend its definition or exemptions during this period.
Forthe foregoing reason, the Board hereby dismisses this proceeding.
