Pursuant
to Section
17.5
ofthe Environmental Protection Act (Act), the Board would
normally propose amendments to Illinois regulations that are “idenflc~-in-subs~ce1”to
drinking water rules adopted by USEPA pursuant to Sections
1412(b), 1414(c),
1417(a),
and
1445(a) of the Safe Drinking Water Act (P.L.
93-523),
as amended (SDWA).
In accordance
thereto, the Board reserved this docket to incorporate into Illinois law those USEPA
amendments made during the period from July
1
through December 31,
1995.
However, during the specified update period,
USEPA did not amend its 40 CFR
141
through 143
SDWA regulations in any way that would require Board action.
Further,
although 40 CFR
136, appendices B and C are incorporated by reference at Section 611.102 of
the Illinois SDWA regulations,
none of the federal amendments to 40 CFR
136,
on August 2
and 28 and October 16,
1995 (61 Fed.
Reg.
39586, 44670,
and 53529, respectively),
affected
the incorporated segments of those federal rules.
Forthe foregoing reason, the Board hereby dismisses this proceeding.
