    ORDER OF THE BOARD (by G.

    Girard):
    On September 14,
    1995, the Illinois Environmental Protection
    Agency
    (Agency) filed a motion for expedited hearing and
    expedited Board decision.
    On September 21,
    1995, Harris Marcus
    Group,
    Inc. filed a response in opposition to the motion.
    As the
    Agency
    correctly points out the newly adopted amendments to
    Section 218.104, which require compliance in March of 1996, are
    stayed as to the petitioner during the pendency of this variance.
    However, the Board believes that the petitioner’s response
    indicates that the granting of this motion may be premature.
    Therefore, the Board denies the Agency’s motion for expedited
    hearing and decision at this time.
