    Brunetto Brothers Mobil (Brunetto)
    filed a petition for review
    of an Illinois Environmental Protection Agency
    (Agency) modification of Brunetto’s
    Leaking Underground Storage
    Tank
    Soil Classification and Groundwater Investigation
    Plan on May
    5,
    1995.
    The
    final determination concerns Brunetto’s facility located at
    501
    East Central, Benld, Macoupin County, Illinois.
    This matter was accepted for hcaring on
    June
    15,
    1995.
    On July
    10, Brunetto filed a notice of waiver of 120-day decision period.
    On January 30,
    1996, the Agency filed a petition to file record and motion to file
    record instanter.
    The Agency states that the assigned attorney was unable to complete
    preparation of the Agency record within
    14 days upon notice ofthe June
    12, 1995
    petition
    and the Agency feels that filing ofthe record instanter does not prejudice the petitioner.
    The Board accepts the Agency’s record and grants Agency motion to file record
    instanter.
