ORDER OF THE BOARD
(J. Theodore Meyer):
This matter comes before the Board on a September 6,
1995
Amended Petition for Variance filed by the Village of Lake in the
Hills
(Village) under case number PCB 95—108.
A final Board
order was entered in PCB 95-108 on July 7,
1995;
therefore, the
docket is closed and an amended petition cannot be accepted.
In
addition, the 35—day period for reconsideration or appeal elapsed
before this filing was received; therefore,
the Board will not
accept it as a motion to modify the July 7,
1995 Board order.
The Board also notes that, according to the Illinois
Environmental Protection Agency, no signed Certificate of
Acceptance was received from the Village.
The Board will, however, accept this filing as a new
petition for variance and open a new docket, PCB 96-67.
Village
is directed to submit the $75.00 filing fee.
Submission of the
filing fcc will re-start the Board’s
decision timeclock in this
matter.
Failure to submit the filing fee on or before November
6,
1995 will subject this petition to dismissal.
