    unclear

    to its hearing waiver
    (paragraph 11).
    Petitioner should restate
    its waiver under Procedural Rule
    401(b)
    and clarify whether
    “objections’ refers
    to an objection
    filed within 21 days of
    the filing of the Petition or whether
    the berm is meant
    to mean the filing
    off an adverse recomrnen-
    dation by the Agency.
    If this inadequacy
    is not corrected
    within 45 days of the date of this Order,
    this matter will
    be subject
    to dismissal.
    The statutory 90—day decision period
    shall run from the date
    an amended petition
    is
    filed.
