This matter is before the Board on a complaint filed on
February 10,
1995 by Don Carson Steinheimer and Ray Darrow
Steinheimer as Co-Executors of the Estate of Irene
D.
Steirtheimer, deceased,
(Steinheimers)
against GTE North,
Inc.
(GTE).
The complaint alleges that GTE has violated Sections 12,
21 and 18(a) (2)
of the Environmental Protection Act
(415 ILCS
5/12,
21,
18(a)(2)
(1992)),
arid
Section
620.405 of the Board’s
Groundwater Regulations (35 Ill. Mm. Code 620.405), as a result
of GTE’s storage, disposal, and handling of petroleum products
and waste materials.
The complaint also requests the Roard
set
a
date for hearing.
By Board order of April
6,
1995 the Board determined this
complaint was neither duplicitous nor frivolous and sent the
matter to hearing.
On April
14,
1995 GTE filed a Motion to
Decide Proceeding on the Merits.
On April
25,
1995 the
Steinheimers filed
a
Motion
to
Strike Respondent GTE’s Motion to
Decide Proceeding on the Merits.
On May 2,
1995 GTE filed a
Response to Complainants’ Motion to Strike GTE’s Motion to Decide
Proceedings on the Merits.
The
Board
will take all outstanding
motions with the case.
The Board hereby directs the assigned hearing officer to
promptly proceed to hearing.
The hearing officer and the parties
are encouraged to expedite this proceeding as much as possible.
