ORDER OF THE BOARD (by Dr. Satchel?)
On April 18, 1980 the Environmental Protection
Agency filed
a motion to dismiss the variance petition
filed April 3, 1980 by
the Village of Sauget (Sauget), which requests a variance from
Rules 601(c) (1) and (2) of Chapter 3:
Water Pollution regarding
combined sewer overflows.
The petition states that a variance is
needed to allow planning of a new facility
which will not conform
with these rules.
Sauget recognizes the need for permanent relief
and states that it will file a regulatory proposal within four
months, but that a variance is needed to allow planning to proceed
towards submission of a permit application
in November 1980.
Al-
though Board rules forbid issuance of construction permits for
facilities which will not conform with its rules, these rules do
not forbid planning such a facility. The petition is dismissed
without prejudice to Saugets right to file a new petition when
the issue is ripe.
