ORDER OF THE BOARD (by T.E. Johnson):
On July 30, 2001, Ila M. Neathery and Denise C. Fleck (complainants) filed a complaint
alleging that the respondents violated Section 24 of the Environmental Protection Act (Act) (415
ILCS 5/24 (2000)), as well as 35 Ill. Adm. Code 900.102 and 900.104. The complainants further
alleged that the respondents violated these provisions by emitting noise resulting from live
bands, patrons, and a sound system that unreasonably interferes with the use and enjoyment of
the complainants’ property and health. The complaint concerns the respondents’ bar and dance
hall located in Chatham, Sangamon County.
On December 3, 2001, the complainants filed a motion to voluntarily dismiss this matter.
In the motion, the complainants represent that respondents Greg and Karen Bouillon d/b/a
Thirsty’s are no longer conducting business at the property owned by respondents Terrill L. and
Sarah E. Loving. The complainants request that the Board grant their motion to dismiss. To
date, the respondents have filed no response to the motion. The complainants’ motion to dismiss
is granted, and the docket is closed.
IT IS SO ORDERED.
I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, certify that the Board
adopted the above order on December 20, 2001, by a vote of 7-0.
Dorothy M. Gunn, Clerk
Illinois Pollution Control Board
