ORDER OF THE BOARD (by N.J. Melas):
On April 30, 2001, petitioners Rhodia Inc. (Rhodia) and the Thorn Creek Basin Sanitary
District (TCBSD) filed their petition for an adjusted standard in this matter. Pursuant to a Board
order, Rhodia and TCBSD filed an amended petition on August 27, 2001. On September 20,
2001, the Board on its own motion added Takasago Corporation (U.S.A.) and Consumers Illinois
Water Company (CIWC) as parties to this proceeding. On November 30, 2001, the Illinois
Environmental Protection Agency recommended that the Board grant petitioners the requested
relief in this matter with respect to 35 Ill. Adm. Code 302.208 but not 35 Ill. Adm. Code
304.105. On December 4, 2001, CIWC filed a statement in support of the relief requested by
Rhodia and TCBSD.
On December 5, 2001, Rhodia and TCBSD filed a motion (motion) for expedited review
with the Board. In the motion, Rhodia and TCBSD state that Rhodia is already suffering
financial loss from compliance with current regulatory requirements. Specifically, they claim
that when Rhodia reaches the discharge limits in its National Pollutant Discharge Elimination
System (NPDES) permit before the end of the month, it shuts down production “resulting in the
loss of hundreds of thousands of dollars in revenue.” Motion at 2. Rhodia and TCBSD also
claim that Rhodia “cannot properly plan its production and assess its facilities” without a Board
decision on its petition.
Id.
Although the Board must take time to carefully consider the relief that petitioners have
requested and the other documents filed in this matter, the Board grants the motion for expedited
review. The Board anticipates issuing a decision in this matter at the next scheduled meeting of
the Board on January 10, 2002.
