    ORDER OF THE BOARD (by S.T. Lawton, Jr.):
    On November 30, 2001, the Illinois Environmental Protection Agency (Agency) filed a
    proposal for rulemaking under Section 27 of the Environmental Protection Act (Act). 415 ILCS
    5/27 (2000). The Agency proposes to amend Section 201.142 and add Section 201.170 of the
    Board regulations (35 Ill. Adm. Code 201.142), concerning permitting provisions for the control
    of air pollution. The proposal seeks to exempt certain smaller units from the requirement for
    owners and operators to obtain new construction and operating permits that are required by
    Section 39 of the Act (415 ILCS 5/39 (2000)), each time they change the site of an emissions
    unit or units.
     
    The petition meets the content requirements of Section 102.202 of the Board’s procedural
    rules.

    the hearing officer assigned to this matter to schedule hearings as required by Title VII of the
    Act.
