ORDER OF THE BOARD (by N. McFawn):
On October 6, 1994, Indian Refining Limited Partnership
filed a petition for a site—specific rule to be applicable to its
refinery located in Lawrence County, Illinois. On October 20,
1994, the Board issued an order directing petitioner to cure
several deficiencies in its petition. In addition to the
failure to file proper notices of filing and appearances, the
deficiencies included failure to comply with the requirements of
35 Ill. Adm. Code 102.121(h), 35 Ill. Mm. Code 102.121(c), and
35 Ill. Adm. Code 102.121(g). In the October 20, 1994 order, the
Board noted that failure to cure the identified deficiencies
within 45 days would subject its petition to dismissal.
Despite the extended period of time that has elapsed since
the October 20, 1994 order, petitioner has failed to cure the
identified deficiencies, or to take any further action in this
rulemaking docket. Therefore, this docket is dismissed. If at a
future date petitioner wishes to seek a site—specific rule, a new
petition satisfying the above criteria must be filed, in which
case a new docket will be opened.
