ORDER OF THE BOARD (by J. Theodore Meyer):
This matter comes before the Board on a March 6, 1996 Joint Status Report and Request
for Extension of Stay filed by Hydrosol,
Inc. (Hydrosol) and the Illinois Environmental
Protection Agency (Agency).
The parties state that since this petition was filed, the Agency
proposed an amendment to 35 Iii. Adm. Code 218,
Subpart DD which would providethe relief
Hydrosol is seeking in this Adjusted Standard.
On May
19,
1995,
the amendment was published
as a final rule in the Illinois Register.

Subsequently, the Agency submitted this rulemaking to the United States Environmental
Protection Agency (USEPA).
Since this rulemaking was considered anon- controversial
revision, the USEPA published both the proposed rule and final rule on January 26,
1996.
However, the parties state that the USEPA received comments during the commentperiod
and
is
considering publishing another notice in the Federal Register to address those comments.
As a
result, the parties request a continuation ofthe stay in this matter until final approval of 35 Ill.
Adm. Code 218,
Subpart DD, as amended in R94-2l.
The Boardhereby accepts the parties’ joint status report
and
grants a stay in this matter
until the USEPAapproves the amendments to 35 Ill. Adm. Code 218,
Subpart DD.
Hydrosol is
directed to file astatus report on or before June
19, 1996 which will include a synopsisof the
activity in this matter.
