This matter is before the Board on Citizen Utilities of
Illinois’
(Citizens)
status report and motion to further defer
proceedings filed on October 13, 1995.
Citizens requests that
the Board extend the stay in this matter for an additional 90
days in order to allow the Illinois Environmental Protection
Agency (Agency)
sufficient time in which to issue a NPDES permit
consistent with a settlement agreement reached between Citizens,
the
U.S.EPA
and the Agency in a federal enforcement action.
Citizens states that when the NPDES permit is issued,
this docket
will be moot and will be withdrawn.
Accordingly, Citizens’ request of a 90-day extension is
granted.
Regarding future status reports, Citizens and
additionally, the Illinois Environmental Protection Agency, are
both directed to file a status report, either jointly or
individually, on or before January 13,
1996.
The status report
is to indicate the status of the NPDES permit, whether additional
time will be required or whether it will be necessary to proceed
with this rulemaking.
In the event the permit is issued sooner
than anticipated,
Citizens is requested to file the appropriate
motion withdrawing R81-19.
