I dissent from the majority order to highlight the fact that

the Illinois Environmental Protection Agency

(Agency) has not

filed its response

in

this matter.

On September

7,

1995 the

Board,

in reporting that an amended petition had been received in

this matter,

indicated that it would hold its decision until the

Agency filed its response.

More

than

30

days

have

passed

with

no

Agency response.

This is the second time in this case that the

Board has had to set a deadline for an Agency response.

I find

this Agency hand-holding to be unnecessary and especially

troubling in an 11-year-old case.

For these reasons,

I respectfully dissent
