to Amend “Stipulation and
Proposal For Settlement” and Order of the Board is granted.
Attached
to Interlake’s motion is
a copy of the amended
stipulation and proposal for settlement duly signed by
representatives of the MSD,
the Agency, and Interlake.
Read
literally, the Board’s procedural
rules can require an
additional hearing on the amended settlement agreement.
The
Board hereby waives any requirement of further hearing inasmuch
as this enforcement case
is now five years old,
inasmuch as
acceptance of the amended stipulabion contemplates Interlake’s
compliance within five months hereof, and inasmuch as all parties to
this action agree that the amended stipulation will dispose of
the matter.
The final Opinion and Order of the Board will follow.
