    (Rulemaking – Water)
    ORDER OF THE BOARD (by C.A. Manning, G.T. Girard, and R.C. Flemal):
    On November 9, 2001, the Illinois Environmental Protection Agency (Agency) filed a
    proposal for rulemaking under Section 27 of the Environmental Protection Act (Act), 415 ILCS
    5/27 (2000), to fulfill the requirements of Section 303(c) of the Clean Water Act (33 U.S.C.
    1313(c)). The Clean Water Act requires that, at least once every three years, states must “review
    water quality standards to ensure that the standards are based on the most current information
    and are protective of the designated uses of waters of the State.” Agency Stat. of Reas. at 9.
    The Board accepts the proposal for hearing and directs the hearing officer assigned to this
    matter to schedule hearings as required by Title VII of the Act.
