ORDER OF THE BOARD (by R.C. Flemal):
This matter is before the Board on a joint stipulation filed by Dixon-Marquette Cement,
Inc. and the Illinois Environmental Protection Agency. In the stipulation, the parties request that
the Board dismiss Dixon-Marquette Cement, Inc., and name Prairie Material Sales, Inc. as
petitioner.
The parties explain that Prairie Material Sales, Inc. acquired the Dixon-Marquette plant
under an agreement with Lone Star Industries, Inc. in 1982. Pursuant to the agreement, Prairie
Material Sales, Inc. and Lone Star Industries Inc. formed a corporation known as Dixon-
Marquette Cement, Inc.. In 1987, Prairie Material Sales, Inc. acquired all of Lone Star
Industries, Inc. interest in Dixon-Marquette Cement, Inc., and Dixon-Marquette Cement, Inc.
was merged into Prairie Material Sales, Inc.. The parties agree that Prairie Material Sales, Inc. is
the appropriate party to bring this action for an adjusted standard.
The Board dismisses Dixon-Marquette Cement, Inc. from this matter and amends the
caption to reflect that Prairie Material Sales, Inc. is the petitioner. At the parties’ suggestion, all
references to Dixon-Marquette Cement, Inc. in any previously filed pleading in this matter shall
mean Prairie Material Sales, Inc..
