ORDER OF THE BOARD (by C.A. Manning):

On September 6, 2001, the Board, at the parties’ request, extended until October 22,
2001, the time period within which Rezmar Corporation (Rezmar) may appeal a July 19, 2001
determination of the Illinois Environmental Protection Agency (Agency).
    See
    415 ILCS 5/40
(a)(1) (2000); 35 Ill. Adm. Code 105.406. The Agency denied in part, Rezmar’s request for
reimbursement from the Underground Storage Tank Fund, regarding an underground storage
tank site in Chicago, Cook County.

On November 1, 2001, the Board dismissed this case and closed the docket. However,
the Board staff has since determined that the extension should have been issued until December
11, 2001, 125 days from the date Rezmar actually received the Agency’s decision on August 8,
2001. Accordingly, the Board vacates the November 1, 2001 order. The Board extends the
appeal period until December 11, 2001. If Rezmar fails to file an appeal on or before that date,
the Board will dismiss this case and close the docket.

    IT IS SO ORDERED.

    Board Member N.J. Melas abstained.

I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, certify that the Board
adopted the above order on November 15, 2001, by a vote of 6-0.
