This letter rescinds the Agency’s formal request regarding Docket R02-5, which includes
proposed language for adoption of the January 26,
2001
Federal Register
promulgation
ofthe arsenic regulation through the identical in substance process. TheAgency requested
that the Board withdraw its
proposal to adopt the federal arsenic language until such time
as final language has been determined
by USEPA.
The October 31,
2001, press release
and notice
regarding the implementation of the January 26,
2001
regulation
removes all
uncertainty regarding the
arsenic rule.
Region
5
will
begin
review of the entire
R02-5
Docket.
The
Agency
continues
its
review the
Docket,
and
will
transmit
comments
prior
to
the
December 10,
2001 deadline.
