ORDER OF THE BOARD (by R.C. Flemal):

On September 20, 2001, petitioner filed a petition for variance (petition) and a motion for

granted petitioner’s motion, and ordered petitioner to file two hard copies of the exhibit and eight
CD-ROM copies with the Board. On October 16, 2001, in response to the Board’s October 4,
2001 order, petitioner filed the appropriate copies. In the petition, petitioner requests a hearing
pursuant to 35 Ill. Adm. Code 104.204(n). The Board accepts the matter for hearing.

It is the responsibility of the hearing officer to guide the parties toward prompt resolution of this
matter, through whatever status calls and hearing officer orders he determines are necessary and
    appropriate

Unless otherwise ordered by the hearing officer, the Agency recommendation must be
filed with the Board within 45 days after the filing of the petition (in this instance, October 16,
2001), or where there has been a hearing scheduled, at least 30 days before hearing, whichever is
earlier. See 35 Ill. Adm. Code 104.216(b).

    IT IS SO ORDERED.
