Trivoli’s November 12,
1980 petition for extension of
variance is deficient in certain respects.
Petitioner’s
attention
is directed to Rules 401 and 402 of the Board’s procedural rules.
The following deficiencies are noted.
1.
Petitioner should request the incorporation of the
records Opinion, and Order
in the prior proceeding
(PCB 79—198)
into
the new petition.
2.
Petitic~nershould allege that the situation as it exists
now is substantially the same as it existed at the time of the
prior proceeding.
3.
If Petitioner does not request a hearing,
it n.~stinclude
with the petition an affidavit averring to the truth of the facts
presented in the petition.
Petitioner shall have 45 days from the date of this Order in
which to amend the petition herein.
Failure
to so
amend the
petition may result in a dismissal.
The statutory 90—day period
for decision shall begin upon receipt by the Board of the amended
petition.
