This letter is a comment on a portion of Docket R02-5, which includes proposed language
for
adoption
of
the
January
26,
2001
Federal
Register
promulgation
of
the
arsenic
regulation through
the identical
in substance process.
The Agency has been
in contact
with USEPA Region
5.
The Region
is unwilling to review or comment upon the regulation
until
such
time
as
comments
from
the
October
5,
2001,
Notice
of
Data
Availability
publiƶation in the
Federal Register
have
been received, reviewed and
a final determination
issued as to whether or not changes will
be made to the January 26,
2001, promulgated
rule.
TheAgency respectfully requests thatthe
Board withdraw its proposal to~adoptthe
federal
arsenic language until such time as final language has been determined by USEPA.
It is
impossible for either
Region
5 or the
Agency to
comment
with
any certainty upon
the
arsenic language portion of proposed
Docket R02-5 at this time.
The Agency continues to review the remainder ofthe
Docket, and will transmit comments
for the remaining
portion under separate cover.
