The Agency’s October 22,
1980 Motion for Reconsideration is
denied.
The Board’s Opinion makes it quite clear that the burden of
compliance is upon the Respondent, who is “to cease and desist from
further violations, and to develop a plan to bring each STP into
compliance”
(Opinion and Order of September 18,
1980 at
6).
It
is the Respondent’s responsibility to contact the Agency concerning
his compliance plan.
It lies within the Agency’s administrative
discretion to handle questions of “engineering consulting” versus
continuing to make its “personnel routinely..

regulatory requirements.”
As no additional duty has been imposed
on the Agency,
no relief from the Board’s Order is necessary.
