ORDER OF THE BOARD

Anderson):
Section 21(h) (formerly g)
of the Environmental Protection Act
(Act)
states that no person shall:
“Deposit any hazardous hospital waste
in any landfill
on or after January
1,
1981.
All such waste shall be
properly incinerated or processed by an alternative
method pursuant to regulations adopted by the Board.
This requirement shall take effect January
1,
1981.”
The Board has received no proposals for rulemaking to implement
this section.
Upon its own motion,
the Board hereby authorizes the
scheduling of at least two inquiry hearings on this matter pursuant
to Procedural Rule 216 and Sections 5(b) and 5(d) of the Act.
The
hearings shall be held to elicit comments,
to include,
in par-
ticular,
the following areas:
1.
The proper interpretation and scope of Section
3(jj)
(formerly t) of the Act defining hazardous hospital wastes as
“wastes generated in connection with patient care that is
sic
contaminated with or may be contaminated with an infectious agent
that has the potential of inducing an infection and has not been
rendered innocuous by sterilization or incineration.”
2.
The definitional relationship,
if any, between “hospital
pathological wastes”
listed as an “industrial process waste” in
Section 3(i)
(a sub—category of Section 3(aa)
“special waste”),
and “hazardous hospital wastes” as defined
in Section
3(jj).
3.
The existence and availability of methods,
in addition
to “proper” incineration, for processing of hazardous hospital
wastes, pursuant to Sec.
21(h).
4.
A comparison of the scope of Sections
3(jj)
and 21(h)
of
the Act with applicable Federal laws and regulations in this area.
