ORDER

OF THE BOARD

On September 12,

1980 the City of Staunton filed a petition

requesting a variance from the 15 mg/i suspended solids limitation

of NPDES permit No. IL005ll28 for public water supply filter back-

wash and settling basin discharges.

The petition lacks

a specific

identification of the particular provisions of the regulations

from which the variance

is sought

Procedural

Rule 401(a) (2).

The Board does not grant variances from permit conditions, but may

order modification pursuant to a variance from the underlying

regulations

(Rule 914 of Chapter 3:

Water Pollution).

Since

Petitioner has waived a hearing, an affidavit or other proof

should be provided pursuant to Procedural Rule 401(b).

The

petition will be subject to dismissal unless the noted defic-

iencies are remedied with an amended petition filed within forty-

five days of the date of this Order.

The decision period will

commence with the filing of an amended petition.
