The Agency’s August 20,

1980 motion to keep the records of

the above proceedings open, pending its anticipated filing of new

regulations pursuant to §9.2 of the Illinois Environmental Protection

Act by December 1,

1980,

is granted.

However, the Board is of the

opinion that the Agency would be in bad faith were it to wield

the corresponding SIP provision

(Rule 204(c)(1)(A),

as originally

adopted in 1972)

against affected sources prior to the adoption

of the §9.2 regulations.

IT IS SO ORDERED.
