Celotex’ August 19,
1980 request for appeal of the hearing
officer’s order of May 22,
1980 is mooted by the Board’s
Order of July 10,
1980.
Under that Order, discovery-related
pleadings filed between August 30,
1979 and July 9,
1980 were
denied.
Inasmuch as Celotex objects to the Agency’s statement listing
and justifying discovery it deems necessary,
such objection is to
be addressed to the hearing officer and not to the Board.
The Agency’s motion of August 29,
1980 to strike Petitioner’s
appeal is mooted.
IT IS SO ORDERED.
