ORDER OF THE BOARD (by E.Z. Kezelis):
On August 8, 2001, Universal Scrap Metals, Inc., filed a motion to dismiss. Attached to
the motion was a stipulation executed by both parties for dismissal of this case with prejudice.
While the Board granted the motion by order of August 23, 2001, its order did not specify that
the dismissal was with prejudice, even though a dismissal with prejudice had been requested by
the parties. Accordingly, the Board now clarifies that the dismissal of this case, granted by
Board order of August 23, 2001, is with prejudice.
