ORDER OF THE BOARD (by C.A. Manning):

On June 7, 2001, the Board, at the parties’ request, extended until August 30,
2001, the time period within which the Village of Bensenville (Village) may appeal an
April 27, 2001 determination of the Illinois Environmental Protection Agency (Agency).
    See
    415 ILCS 5/40 (a)(1) (2000); 35 Ill. Adm. Code 105.406. The Agency modified the
proposed budget for the physical soil classification and groundwater investigation plan
regarding an underground storage tank site at 500 South York Road, Bensenville, DuPage
County. Because the Village failed to timely file an appeal, the Board dismisses this case
    and closes the docket.

    IT IS SO ORDERED.

I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, certify that the
Board adopted the above order on September 6, 2001, by a vote of 7-0.
