ORDER OF THE BOARD (by R.C. Flemal):

 

 

On May 21, 2001, the Dixon Marquette Cement Company (petitioner) filed this

petition for an adjusted standard pursuant to Section 28.1 of the Environmental Protection Act

(Act). 415 ILCS 5/28.1 (2000). Petitioner requests that the Board grant an adjusted standard

from 35 Ill. Adm. Code 811.309, 811.317, 811.318(b) and (c), 811.319(a), (b) and (c),

811.320(a), (b), and (c), and 814.302(b) of the Board’s regulations regarding landfill

operations. Petitioner properly published notice on

May 23, 2001, and filed a certificate of publication with the Board on June 14, 2001. On June

11, Jerry McNair, a Lee County resident, filed a request for hearing in this matter.

 

Hearings shall be scheduled and completed in a timely manner. The assigned hearing

officer shall inform the Clerk of the Board of the time and location of hearing at least 40 days in

advance of hearing so that a 30-day public notice of hearing may be published.
