ORDER OF THE BOARD (by N.J. Melas):
On September 25, 2000, the City of Sycamore (Sycamore) filed a petition for an adjusted
standard pursuant to Section 28.1 of the Environmental Protection Act (Act). 415 ILCS 5/28.1
(2000). Sycamore requested that the Board grant it an adjusted standard from 35 Ill. Adm. Code
304.121 and 306.305(b) regarding Sycamore’s treatment of effluent from its excess flow treatment
facility that is part of its wastewater treatment plant.
On November 2, 2000, the Board found several deficiencies in Sycamore’s petition. The
petition did not adequately address certain proof required by Section 28.1(c) of the Act (415 ILCS
5/28.1(c) (2000)). On November 2, 2000, the Board ordered that Sycamore file an amended petition
for an adjusted standard in order to address the deficiencies. Sycamore filed its amended petition on
March 6, 2001.
On May 17, 2001, the Board issued an order in which it found two deficiencies in the amended
petition; Sycamore failed to adequately address the requirements of Section 28.1(c)(1) of the Act (415
ILCS 5/28.1(c)(1) (2000)) and it failed to submit adequate proof for its proposed exemption from the
Board’s fecal coliform standards. The Board directed Sycamore to address these deficiencies in
addendum to the amended petition. The Board ordered that the addendum be filed by June 18, 2001.
On June 15, 2001, Sycamore filed a motion to extend time to file an addendum to amended
petition (motion). In the motion, Sycamore’s attorney states that Sycamore has been working diligently
to address the deficiencies in the amended petition. However, Sycamore’s engineer has been involved
with another time-intensive project and has not had sufficient time to devote to preparing the addendum.
Sycamore requests an additional 60 days to file the addendum.
The Board grants Sycamore’s motion. The new filing deadline for the addendum will be August
17, 2001. If the Board does not receive the addendum by August 17, 2001, this matter will be
dismissed.
Sycamore’s petition in this matter was filed nearly nine months ago, and the Board has already
provided Sycamore with two opportunities to correct deficiencies in the petition and amended petition.
In addition, the Board has been generous in providing Sycamore sufficient time to correct the

deficiencies. As a result, the Board is reluctant to grant Sycamore additional requests for extensions of
time to correct the deficiencies.
The Agency shall file a recommendation in this matter within 45 days after the addendum is filed
with the Board. See 35 Ill. Adm. Code 104.416(a).
