    ORDER OF THE BOARD (by C.A. Manning):
     
    On May 29, 2001, the People of the State of Illinois filed a five-count complaint against
    Wagner Castings Company, Inc. (Wagner). The complaint alleges Wagner caused or allowed
    improper disposal of waste, caused or allowed construction of new emissions sources without a
    permit, caused or allowed violations of prevention of significant deterioration requirements,
    failed to file annual emissions reports, and operated new emissions sources without a permit at
    its facility located at 1275 Sangamon Street, Decatur, Macon County, Illinois. These activities
    were in alleged violation of Sections 9(a), 9(b), 9.1(d)(1), 9(d)(2), and 21(e) of the
    Environmental Protection Act (Act) (415 ILCS 5/9(a), 9(b), 9.1(d)(1), 9(d)(2), 21(e) (2000)),
    the Board’s solid waste regulations at 35 Ill. Adm. Code 722.111, 722.120(a), and 728.135(a),
    the Board’s air pollution regulations at 35 Ill. Adm. Code 201.142, 201.143, 201.302, and
    254.202(b), and 40 C.F.R § 52.21(i), (j), and (k). The Board accepts this matter for hearing.
     
    The Board directs that this matter proceed to hearing as expeditiously as practicable.
    The assigned hearing officer must set the matter for hearing in accordance with the
    requirements of the Act and the Board’s procedural rules. It is the responsibility of the hearing
    officer to guide the parties toward prompt resolution or adjudication of this matter, through
    whatever status calls and hearing officer orders he determines are necessary and appropriate.
