ORDER OF THE BOARD (by N.J. Melas):

On June 4, 2001, the People of the State of Illinois (complainant) filed a motion to
correct misnomer of Benton & Associates Engineering, Inc. (motion). Complainant requests
that the Board change the name of one of the respondents from Benton & Associates
Engineering, Inc. to Benton & Associates, Inc. Complainant indicates that counsel for Benton
& Associates, Inc. does not object to the motion.

Section 103.202 of the Board’s procedural regulations provides that “the name of any
party may be corrected at any time”. The Board grants the motion.

The Board also notes that on April 5, 2001, it accepted the stipulation and proposal for
settlement between complainant and respondent City of Auburn (Auburn). Auburn is no
longer a party to this proceeding, and the Board will delete Auburn from the caption.

The caption in this order reflects the corrections to the names of the parties.

    IT IS SO ORDERED.

I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, hereby certify that
the above order was adopted on the 7th day of June 2001 by a vote of 7-0.

    Dorothy M. Gunn, Clerk
    Illinois Pollution Control Board
