On May 29, 2001, Stanley Yonkauski, on behalf of the Illinois Department of Natural
Resources (DNR), filed a “petition for leave to intervene.” In support of its motion DNR states
“[DNR] is the state agency charged with, inter alia, the responsibility for statewide management
of Illinois’ natural resources including aquatic resources that could be impacted by the
regulatory proposal,” and “furthermore, [DNR] may be able to provide information relative to
the decision of the Board on this application as it may affect the state’s natural resources.”
The Board welcomes DNR’s participation, both at hearing and in the public comment
process. But, the petition for leave to intervene is unnecessary as there are no “parties” in
regulatory proceedings, as there are in contested cases. Accordingly, the petition for leave is
denied.
