    HEARING OFFICER ORDER

As stated in the hearing officer order of April 25, 2001, two hearings are scheduled in this
matter: June 7, 2001, in Springfield; and June 20, 2001, in Chicago. As that order provided, the
deadlines for the Clerk of the Board (Clerk) to receive prefiled testimony are as follows: May
23, 2001, for persons who wish to testify at the Springfield hearing; and
June 13, 2001, for persons who wish to testify at the Chicago hearing. The Illinois
Environmental Protection Agency, as the proponent of the rulemaking, must prefile its testimony
    for the June 7 hearing.

Consistent with the Board’s April 19, 2001 order in this matter, any person who cannot
attend a hearing to testify or who does not wish to testify may file a written public comment with
the Clerk. The Board would like to receive public comments on the Agency’s proposal before
the June 7 hearing. Of course, the Board will accept public comments from anyone until the
public comment deadline, which will be established at the conclusion of the hearings.
Accordingly, any persons, including those who testify and those who file public comments before
hearing, may file public comments after hearing.

Anyone who files a public comment with the Clerk must, at the time of filing, serve all
persons on the service list with a copy of the comment. Because the service list may be modified
from time to time, persons filing any document with the Clerk should contact the hearing officer
to ensure they have a copy of the current service list.

    IT IS SO ORDERED.
